A common assumption in divorce cases is that the mother always gets physical custody of the children. While this does happen many times, it is not necessarily true. There are many factors that will affect who the courts award custody to including each parent's fitness, previous relationship, and ability to provide. Neither the father nor mother have special rights that preclude the other from being awarded primary custody.
